This Privacy Policy describes the policies and procedures of Performing AI LLC, a Washington limited liability company ("Performing AI LLC", "the Company", "We", "Our", "Us"), on the collection, use, and disclosure of your information when you use the Service (Invoice App) and informs you of your privacy rights and legal protections.
Data Controller vs. Data Processor
For the purposes of applicable data protection laws (including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA)), when you use our Service to manage your clients' invoices, you act as the Data Controller of your clients' data. The Company acts strictly as the Data Processor on your behalf. You are solely responsible for ensuring you possess a lawful basis and all necessary consents to process your clients' data.
Collecting and Using Your Personal Data
Types of Data Collected
Personal Data
While using our Service, We may request that you provide certain personally identifiable information that can be used to contact or identify you. This may include:
- Email Address (Optional): Collected only if you explicitly choose to enable optional cloud synchronization and backup features. We support third-party authentication via Google, Apple, and Microsoft Sign-in. No account registration or authentication is required to utilize the core offline application.
- Anonymized Usage Data and Diagnostics: We utilize Google Firebase to collect anonymized usage analytics, performance metrics, and crash logs to monitor and improve the Service. This diagnostic data does not contain your business records or invoice contents.
- Invoice Data: Stored locally on your device by default (as detailed below).
Business and Invoice Data (Local-First Architecture)
The Service is designed as a local-first application. All invoice data, client names, physical addresses, transaction records, and line items are processed and stored locally on your device's secure storage.
The transmission of this data to our cloud infrastructure is entirely optional and is disabled by default. Data transmission to the cloud is initiated only under the following specific circumstances:
- Cloud Backup and Synchronization: If you explicitly choose to enable secure cloud backups, your data is transmitted and stored securely on Microsoft Azure cloud servers. Microsoft Azure acts as our secure database and cloud hosting sub-processor, utilizing enterprise-level security protocols and compliance frameworks (including ISO 27001 and SOC 2) to safeguard your records. This backup feature can be disabled at any time.
- Optional AI Features: If you explicitly enable and utilize either of the AI-powered features described below, relevant business metrics or transactional data will be processed securely via cloud integrations.
The Company does not sell, rent, or lease your invoice or business data to third parties.
AI and Automation Features (Google Gemini Integration)
The Service offers optional Artificial Intelligence (AI) features powered by Google's Gemini API ("Gemini AI"). These features are categorized into two distinct tools with different data processing requirements:
- AI Sales Agent: This optional tool operates on your public booking page to interact with prospective clients and answer schedule or service queries. It does not require full cloud backup of your historical invoices. When clients interact with this tool, only public service details, available hours, and deposit terms configured by you are processed via the Gemini API.
- AI Business Assistant: This optional internal tool analyzes your financial metrics, business expenses, and invoice records to generate administrative reports and insights. Because this tool requires comprehensive historical analysis of your data, it requires secure cloud backup and synchronization to be enabled on your account to allow Azure to securely compile and process the metrics.
- Data Protection & Model Training: All AI processing is conducted through a secure, enterprise-level integration of Google's Gemini API. In accordance with Google's API terms of service, data processed via the commercial Gemini API is handled securely and is not utilized by Google to train its public foundation models.
- Data Controller Responsibility: Because you act as the Data Controller for your clients' personal data, you must ensure you possess a lawful basis and necessary permissions before enabling AI features that interact with or process client-specific information.
Use of Your Personal Data
The Company may use Personal Data for the following purposes:
- To provide and maintain our Service: including monitoring the usage and performance of our Service.
- To manage Your Account: to manage your registration and authentication as a user of the Service.
- For the performance of a contract: the development, compliance, and execution of purchase contracts for premium subscriptions or associated services.
Delete Your Data
You possess the right to delete or request that We assist in deleting the Personal Data collected about you.
You may completely delete your account and remove all associated data from our servers at any time directly within the application settings.
